Always Eligible

Assumption of Risk, Waiver & Release of Liability

Always Athletes LLC · Effective: September 15, 2026
DRAFT FOR ATTORNEY REVIEW — NOT YET IN EFFECT

Please read carefully

This is a legal agreement between you and Always Athletes LLC (“Always Eligible,” “we,” “us”). By checking the acceptance box and using the Always Eligible app (the “Service”), you agree to every term below. If you do not agree, do not use the Service.

The Service is informational, not medical advice

Always Eligible generates strength, conditioning, speed, and mobility programming based on the answers you provide. The Service does not provide medical advice, diagnosis, or treatment, and no physician, physical therapist, or certified trainer reviews your individual program. Consult a physician before beginning this or any exercise program, and before continuing if you experience pain, dizziness, shortness of breath, or any concerning symptom. This is especially important if you have (or have had) any injury, cardiovascular condition, joint condition, or other medical condition, or if you are pregnant.

Assumption of risk

Exercise — including strength training, Olympic-style lifting, plyometrics, sprinting, high-intensity interval training, and use of fitness equipment — is strenuous physical activity that carries inherent risks that cannot be eliminated, including muscle and joint injury, broken bones, heat-related illness, cardiac events, permanent disability, and death. You knowingly and voluntarily assume all risks of using the Service, whether or not a given risk is listed here.

You train unsupervised, at your own direction

All training performed under a program generated by the Service is self-directed. You are solely responsible for: selecting weights and intensities appropriate for you; using correct technique; inspecting your equipment and training environment; training with a spotter where appropriate; and stopping immediately if something feels wrong. Movement demonstrations in the app are simplified animations for general reference only and are not instruction in safe technique.

Waiver and release

To the fullest extent permitted by law, you — for yourself and your heirs, personal representatives, and assigns — release, waive, and discharge Always Athletes LLC and its owner(s), officers, employees, contractors, and agents (the “Released Parties”) from any and all claims, liabilities, damages, and causes of action of any kind arising out of or related to your use of the Service or any training performed in connection with it, including claims arising from the ordinary negligence of the Released Parties. [ATTORNEY: confirm scope of negligence release and enforceability by state; consider whether gross-negligence carve-out language is required.]

Indemnification

You agree to indemnify and hold harmless the Released Parties from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the Service or your violation of this agreement.

Eligibility

The Service is for adults. You represent that you are at least 18 years of age.

Miscellaneous

This agreement is governed by the laws of the State of Maryland, without regard to conflict-of-law rules. If any provision is held unenforceable, the remaining provisions remain in full force. This agreement, together with the Terms of Service and Privacy Policy, is the entire agreement between you and Always Athletes LLC regarding its subject matter. [ATTORNEY: confirm venue/arbitration preference.]
