These Terms of Service (“Terms”) govern your use of the Always Eligible app and related services (the “Service”), operated by Always Athletes LLC. By creating an account or using the Service you agree to these Terms, our Privacy Policy, and the Assumption of Risk, Waiver & Release of Liability presented in the app.
You must be at least 18 years old to use the Service.
Always Eligible generates individualized 4-week training programs from your questionnaire answers, with animated movement references, training history, and record tracking. Features vary by subscription tier. We may improve, modify, or discontinue features over time.
The Service offers a free tier (JV) and paid subscriptions — currently Varsity ($6.99/month), Captain ($9.99/month), and Hall of Fame ($99.99/year). Prices shown in the App Store control if they differ. Paid subscriptions are billed through your Apple ID, renew automatically until cancelled, and can be cancelled anytime in your device's App Store subscription settings; cancellation takes effect at the end of the current billing period. Refunds are handled by Apple under Apple's policies. Prices may change with notice; changes apply at your next renewal. The Service provides fitness programming for general informational purposes only and is not medical advice. Your use of any program is at your own risk, as set out in the Assumption of Risk, Waiver & Release of Liability, which is incorporated into these Terms.
You are responsible for your account credentials and for the accuracy of the information you provide. You agree not to: reverse engineer, copy, resell, or redistribute the Service or its content; use the Service to build a competing product; interfere with the Service's operation or security; or use another person's account.
The Service — including its software, program-generation engine, movement library, animations, brand, and content — is owned by Always Athletes LLC and protected by intellectual-property laws. Your subscription grants you a personal, non-exclusive, non-transferable license to use the app for your own training. Content you create (your logs and records) remains yours; you grant us the license needed to store and sync it for you.
You may stop using the Service or delete your account at any time. We may suspend or terminate accounts that violate these Terms. Sections that by their nature should survive (including the health disclaimer, waiver, IP, disclaimers, and limitation of liability) survive termination.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or produce any particular training result.
TO THE FULLEST EXTENT PERMITTED BY LAW, ALWAYS ATHLETES LLC'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, AND IN NO EVENT SHALL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR PERSONAL INJURY ARISING FROM YOUR TRAINING, WHICH IS GOVERNED BY THE WAIVER.
